Opening remarks

VAL’U SRL takes the protection of your personal data seriously. This document is intended to inform you about how we process your data and protect your rights in this context. 

We pursue the objective of transparency regarding the data we collect and process, as well as regarding the reasons for its collection and processing. We protect your data to the best of our ability, including by refusing to sell or rent it to third parties. We collect and process your data mainly to be able to deliver the products or services you have ordered, as well as to keep you informed of the availability of similar products or services.

This privacy statement (hereinafter the “Statement” or the “Privacy Policy”) lists the personal data we collect – directly or indirectly – and explains how we use and process it.

Personal data is defined as any data that can be used to identify you or that we can link to your person. The Statement also informs you of the choices you can make with respect to the data we collect and how you can manage those choices.

Our Privacy Policy applies to all products offered by VAL’U (hereinafter the “Products”). It also applies to all websites managed by VAL’U, as well as to all other offline contacts, for example when you place an order by post or fax, or when you participate in a  VAL’U event (hereinafter the “Services”).

We invite you to read this Statement carefully to learn how VAL’U may collect, use and share the personal data you send us. The terms “we”, “us”, “our” and “VAL’U” all refer to VAL’U Srl.

Your role and quality in the context of data processing

As personal data is defined as any data that makes it possible to establish a link with a natural person or to identify this natural person, this definition gives a precise indication of the data that VAL’U processes.

The concrete circumstances of the processing depend on the role and quality of the data subject, i.e. the person whose personal data are processed, such as: customer, subscriber, user, prospect, supplier, etc.

In concrete terms, the data to be processed, the purposes of the processing, the basis for the processing, the retention periods, etc. vary according to your role and your quality. The purpose of this Privacy Policy is to list the main circumstances in which VAL’U processes personal data.

In order to adequately take into account the role and quality of the person concerned, we make a distinction according to your role or quality.

Section 1. Your quality

It goes without saying that you can combine several roles or qualities. For example, you can be a customer and at the same time use a Val’U product, participate in an event and provide texts as an author.

If necessary, we invite you to consult the various sections concerned to find out what Val’U does with your data.

Chapter 1. If you are a customer (including a subscriber)

You are a Val’U customer as soon as you order and purchase a product from Val’U and/or one of Val’U’s services.

It can be either the purchase of a product on Kipeps Shop (the online store) or a professional subscription to the Kipeps directory. In this sense, every subscriber is automatically a customer. We treat participation in events as well as the use of a digital product, in a separate section.

  • When does VAL’U process data about you?

When you buy, for example, a product on the stands set up at events or on one of Val’U’s websites.

  • What data does VAL’U process about you?

When you purchase a product from us, we ask you, regardless of the channel used, to provide us with a certain amount of data. This includes your name and address, telephone number, e-mail address, delivery address (or if applicable your shipping address), billing address, payment data, profession or function, VAT number and the sectors of activity corresponding to the products you have ordered and purchased.

  • For what purposes do we process this data?

We process this data in order to complete your transaction (purchase), to monitor the product, to assist you in any delivery difficulties (including returns) and other problems related to the purchase of your product. We group these purposes under the term “customer management”. We do not store payment data, including credit card data. We use them exclusively in connection with the purchase of your product.

  • What is the basis for the treatment?

This processing is necessary for the performance of the contract you enter into with us when making your purchase. The processing of certain data is based on  our legitimate interest in  carrying out our activities, which includes in particular direct marketing. For example, codes assigned to the sectors of activity to which the products you buy belong. We process this data in order to be able to inform you in a targeted manner about other products or services in the same sector of activity or that may be of interest to your profession or function.

  • Do we share your data?

Your data may be shared internally, within Val’U [in particular in order to keep you informed of the products and services we offer and which, given the information we have about you, may be of interest to you.   • What are your rights?

As a customer, you have the right to ask us to consult your data (right of access) and, if necessary, to rectify it (right to rectification) or even to erase it (right to erasure). You can also object (right to object) to the use of your data for direct marketing purposes by Val’U and/or to the sharing of your data with other Val’U business units.

Chapter 2. If you are a user of a digital product (e.g. platform and/or online store “KIPEPS”)

You are a user of a Val’U digital product as soon as you order and purchase a Val’U digital product.

Digital products are defined as online products and applications installed on a stand-alone computer. They have the common characteristic of implying the possibility or the need to process, beyond the basic data, data concerning the use of the products.

  • When does VAL’U process data about you?

When you purchase a digital product on the (dedicated) website of one of the digital products we offer.

  • What data does VAL’U process about you?

When you purchase a digital product from us, we process various data about you. We then subdivide them into additional functional and usage data.

  • Functional data — User and system data

Functional data relates to you, as the user, and to the system.

Data that relates to you as a user is also referred to as registration data. This is the data that supplements your basic identification data as a customer (e.g. your name and address, your function, your company, your telephone and/or fax number, your e-mail address, your VAT number and your geographical area, i.e. language preferences, product serial number, IP address, identification data of your Val’U account.

System data includes, but is not limited to, product type, operating system, software version, network environment, the names of other services you have added or integrated into your Val’U product, and error reports. In other words, this data concerns, for example, the type of browser, the pages visited, the products viewed, etc.

  • Additional usage data

Additional usage data consists of performance information, such as  log files and crash reports, and activity information, such as identifications.

  • For what purposes do we process this data?

We process functional data to  ensure that your Val’U digital products work properly, to provide you with support and to respect your preferences. We group these purposes under the term “digital product management”. 

We may also use this data to improve our products and to offer you other products or services that are relevant to your interests.

We process additional usage data for the following purposes:

  • Content selection, viewing, and  reporting

Collecting information and combining it with previously collected information in order to select and display content for you, and to measure the display and effectiveness of that content. This includes using previously collected information about your preferences to select content, process data about the content displayed, learn how often and for how long that content is displayed, identify where and when you have taken any action in relation to that content.  , for example if you clicked on it. It does not include personalization, which includes the collection and processing of information about your use of this service for the purpose of subsequently providing you with advertising and/or personalized content in other contexts, such as websites or applications.

  • Measure

Collecting information about your use of the Content and combining it with previously collected information in order to measure, understand and report on your use of the Content. This does not include personalization, which includes collecting and processing information about your use of this service for the purpose of subsequently providing you with personalized advertising and/or content in other contexts, such as websites or applications.

  • Ad selection, display and reporting

The collection of information and the combination of this with previously collected information in order to select and display advertising to you, as well as to measure the display and effectiveness   of that advertising. This includes using previously collected information about your preferences to select the advertisement, process the data of the advertisement displayed, learn about the frequency of this display, identify the place and time of this display and/or determine whether you have taken any action in connection with this advertising,  For example, if you clicked on it or made a purchase. It does not include personalization, which includes the collection and processing of information about your use of this service for the purpose of subsequently providing you with advertising and/or personalized content in other contexts, such as websites or applications.

  • Storage and access to information

Storing information or accessing information already stored on your device, such as advertising identifiers, device identifiers, cookies, and similar technologies.

  • Customization

The collection and processing of  information about your use of this service for the purpose of subsequently providing you  with advertising and/or personalized content in other contexts, such as websites or applications. Website or app content is usually used to draw conclusions about your interests and  later select advertising and/or content.

  • What is the basis for this processing?

The processing of functional data is necessary for the proper performance of the contract between us. The processing of additional usage data is based on  our legitimate interest in improving the products we offer and making them more compliant/better adapted to the needs and needs of our customers. We also use these two types of data on the basis of the same legitimate interest in order to offer you products or services that, given the information we have about you, may be of interest to you (direct marketing).

  • Do we share your data?

In principle, we do not share your data with third parties, except in the context of data storage. Where appropriate, it is always shared with subcontractors over whom we have control, on a contractual basis.

  • How long is your data kept?

We store your personal data for as long as you use a digital product from us. We then store them for a maximum period of ten (10) years after the end of the contractual relationship. This period is set by reference to the limitation period under ordinary law in matters of legal defence on the basis of the performance of the contract. 

  • What are your rights?

As a customer, you can ask us not to use your data for the purpose of improving our products or direct marketing (Right to refuse your consent when required/right to object), i.e. to offer you other products or services that may be of interest to you.

Chapter 3. If you are a learner/participant in a training

You are a learner as soon as you register for one of the training courses organized by Val’U.

  • When does VAL’U process data about you?

We need data about you when you register for one of the training courses organized by Val’U. We obtain this data either directly from you when you register personally or from your employer when the latter takes care of your registration.

  • What data does VAL’U process about you?

This includes data such as your name and address, telephone number, e-mail address, profession or function, company, billing address, if applicable your payment data and VAT number, as well as the dates of the training courses and the areas in which the training is provided. When the employer takes care of the registration, data relating to the persons who carry out the registration on behalf of the employer are also processed, as well as payment and billing data communicated on behalf of the employer.

  • For what purposes do we process this data?

We process this data in order to be able to register you for the training you intend to take. We call this purpose “training management”.

We do not store payment data, including credit card data. We use them exclusively as part of the payment for the training.

  • What is the basis for the treatment?

This processing is necessary for the performance of the contract you enter into with us by registering.

The processing of certain data is based on our legitimate interest in  carrying out our activities, which includes in particular direct marketing. For example, this applies to the codes assigned to the areas in which you follow the training. We process this data in order to be able to inform you in a targeted manner about other training courses provided in the same field or that may be of interest to your profession or function.

  • Do we share your data?

There is limited sharing of your data, i.e. with the trainer or teacher so that they can take it into account when preparing the training and, if necessary, with training institutes or other partners that we use to organise the training. In the latter case, this is always done under the control of Val’U.

  • What are your rights?

As a learner or participant, you can ask us to consult your data (right of access) and, if necessary, to rectify it (right to rectification) or erase it (right to erasure). You can also ask us not to use your data to inform you about other training courses that may be of interest to you (right to refuse consent and right to object).

Chapter 4. If you attend an event or contact us

You are a visitor as soon as you come to or participate in an event that we organize or are present at. You can also contact one of our employees by phone or email. We invite you to consult the dedicated section if you do this on the website or by any other electronic channel.

When you wish to obtain more information about Val’U or one of its products or services, you are invited to provide us with various data so that we can communicate this information to you.

When you wish to obtain information about Val’U or one of its products or services, we process the data we need to provide you with this information. This includes data such as your name and address, telephone number, e-mail address, the reason for your action and any other information you (voluntarily) provide to us.

We process this data for the sole purpose of providing you with  the requested information and/or answering your questions.

Val’U processes your data when you browse one of our websites in order to search for information about Val’U or information about products or services presented on one of our websites.

We process data about you when you search for information on our site.

On the one hand, we process the data you provide to us, such as your name and address, telephone number, e-mail address, profession or function, and any other information you provide to us. On the other hand, when you visit one of our websites, we process online information about you by means of cookies or similar technologies, including your IP address.

We process this data in order to provide you with information about the products and services that Val’U offers. Your IP address provides us with geographic information about you as a visitor that allows us to get to know you better and improve our websites for the benefit of all.

This processing is based on our legitimate interest in undertaking and carrying out our activities, which includes answering questions put to us by third parties.

Chapter 6. If you are an author or provide training

You are an author as  soon as you deliver an article or any other contribution published by Val’U.

You are a trainer as  soon as you give/give a training organized by Val’U.

You may also purchase Val’U products or services or use products online. Treatments in this category are discussed elsewhere.

  • When does VAL’U process data about you?

When you deliver a contribution or provide training, we process your data at the time you contact us or when we contact you about that contribution or training.

  • What data does VAL’U process about you?

When you deliver a contribution or provide training, we invite you to provide us with various data. This includes data such as your name and address, telephone number, e-mail address, payment data, profession or function, VAT number and/or business sectors.

  • For what purposes do we process this data?

We process this data in order to manage our relationship with you as an author or trainer. We call this purpose “author management” and “training”. This processing allows us to schedule your contribution or training and ensure that it is paid.

We also process data about you (biography and curriculum vitae) that we publish on our website or in the contribution of which you are the author.

  • What is the basis for the treatment?

This processing is necessary for the performance of the authorship or training contract you conclude with us.

  • Do we share your data?

We do not share your data with third parties, with the exception of authorities to which we are obliged to disclose it (e.g. for tax reasons). It is always up to you to decide how your data appears in the publication or training, and therefore how it is made public.

  • What are your rights?

You always have the right to consult your data (right of access) and, if necessary, to have it rectified (right of rectification). Their erasure (right to erasure) is also part of your rights.

Chapter 7. If you are the contact person or representative of a professional client

Not all Val’U customers are natural persons.

In particular, they may be organizations or legal persons. They act through natural persons who represent them or act as contact persons. In this case, Val’U processes your data, as a contact person or representative of a professional customer (in the form of an organization or legal entity) of Val’U, when this contact or representative orders and purchases a product or service from Val’U, for the organization or legal entity.

  • When does VAL’U process data about you?

As a contact person or representative of an organisation or legal entity, you can buy directly at the stands set up at events or on one of Val’U’s websites, for example. In each of these cases, the data of a natural person acting as contact person must always be entered.

  • What data does VAL’U process about you?

When your organization or legal entity purchases a product from us, we ask you, regardless of the channel used, to provide us with a certain amount of data.

Although these data relate mainly to the organization or legal entity, other data concerning your (natural) person are necessarily processed. This includes data such as your name and title, telephone number and e-mail address. A link may also be made between your data and the domains of the products you order and purchase on behalf of your organisation or legal entity concerned.

  • For what purposes do we process this data?

We process this data in order to carry out the transaction (purchase)  you carry out on behalf of your organisation or legal entity concerned, to monitor the product, to assist you in any delivery difficulties (including returns) and other problems related to the purchase of the product. We group these purposes under the term “customer management”. 

We do not store payment data, including credit card data. We use them exclusively in connection with the purchase of your product.

  • What is the basis for the treatment?

Although the processing of this data is necessary for the performance of the contract that your organisation or the legal entity concerned concludes with us when making its purchase, we do not enter into any contractual relationship with you as a representative or contact person. That is why this processing is based on our legitimate interest in undertaking and conducting our business.

This basis also justifies the processing of data relating to your function and the business sectors to which the products purchased by your organisation or legal entity concerned belong. We process this data in order to be able to inform you in a targeted manner about other products or services in the same sector of activity or that may be of interest to your profession or function.

  • Do we share your data?

In principle, we only process your data internally, within Val’U. However, they may be shared with third parties that Val’U uses, in their capacity as subcontractors or simply third parties. 

In each of these cases, the sharing of your data is limited to what is strictly necessary to perform said services on behalf of Val’U, so that this data sharing is always under the control of Val’U Srl.

  • What are your rights?

As a contact person or representative of an organization or legal entity with the status of Val’U customer, you can ask us not to use your data for direct marketing purposes (right to refuse consent when required/right to object). In this case, you will no longer be kept informed of new publications, training and other in the fields of interest relevant to your interests.

Chapter 8. If you are a prospect

You are a prospect when you have not yet entered into a contractual relationship with Val’U, but Val’U Srl sees in you a (potential) customer who could order a product or service.

Although Val’U may approach customers for the purchase of new products or services, we do not consider them in this privacy statement as prospects. The status of prospect requires the absence of any relationship with Val’U Srl.

  • When does VAL’U process data about you?

The basis for specific marketing actions that Val’U plans or carries out does not consist of data purchased or rented from third parties. And Val’U does not sell or rent your data. Your data is usually collected directly from you or other channels. 

However, if Val’U were to purchase or rent data from third parties, we would inform you on the occasion of the action in which this data would be used, to obtain your consent when required.

In principle, this is relatively general data that allows us to contact you to offer you our products or services in an aggregate way, although it may sometimes be related to a specific sector or area. This includes data such as your name and address, telephone number, email address, profession or function, and areas or sectors of activity.

We process this data to offer you products or services presented on one of our sites.

  • What is the basis for the treatment?

This processing is based on our legitimate interest in undertaking, which includes in particular direct marketing, i.e. activities aimed at contacting new customers.

  • Do we share your data?

Val’U Srl does not sell or rent any personal data to third parties. We only share your data with third parties as described in this privacy statement.

Chapter 9. If you are a supplier or the contact person of a legal entity with supplier status (including a trainer or teacher, for example)

You are a supplier of Val’U as soon as you sell us specific products or services that we need to be able to provide our own services.

We do not see authors as providers, but as partners in knowledge development. We discuss the processing of their data in another section.

  • When does VAL’U process data about you?

When you sell a product or service featured on one of our sites, you are a supplier. In this case, we process your data, either as a supplier or as a contact person or representative of the supplier (if it is an organisation or legal entity), in order to be able to order, pay for and maintain the product or service.

  • What data does VAL’U process about you?

When we purchase a product or service from you, we always process various basic data about you and, if applicable, about your organisation or the legal entity concerned. This includes, for example, data such as your name and address, telephone number, e-mail address, sales address, billing address, payment data, profession or function (if applicable your status as contact person or representative), your VAT number and your sector of activity.

  • For what purposes do we process this data?

We process this data in order to carry out our transaction (purchase of products or services), to request your help in case of possible delivery difficulties (including returns) and other problems in connection with the purchase of the product or service. We group these purposes under the term “supplier management”.

  • What is the basis for the treatment?

This processing is necessary for the performance of the contract we conclude with you by making our purchase.

  • Do we share your data?

We only share your data with the departments responsible for orders and payments (accounting).

  • How long do we keep your data?

We keep your data for as long as you deliver products or services to us. We then keep them for a maximum of ten (10) years after the end of our relationship.

This period corresponds to the limitation period under ordinary law which allows us to contest a performance in court up to ten (10) years after its execution. We must, of course, have the necessary data for this.

  • What are your rights?

In particular, you always have the right to ask us to consult your data (right of access) and, if necessary, to rectify it (right to rectification) or erase it (right to erasure). We invite you to consult the dedicated section to learn how you can exercise these rights.

Chapter 10. If you are a person with a specific interest in VAL’U Srl

You may not be linked in any way to Val’U, but Val’U considers that in the context of its public relations you are of particular interest because you could serve its legitimate interests (in the future) because of your added value in the exercise of its activities.

This opinion may stem from the position you hold (e.g. African private sector professional), the mandate you have been given (e.g. politician or university professor), or the activities you carry out (e.g. lawyer or journalist).

These people have at least two characteristics in common, namely: their professional data is public, on the one hand, and these people are able to create, in one way or another, added value (goodwill) for the benefit of Val’U Srl.

  • When does VAL’U process data about you?

Val’U Srl processes data about you as soon as it considers that you are a person or organization potentially interesting for it and that you can contribute to the exercise of its activities.

  • What data does VAL’U process about you?

Val’U processes various basic data about you, such as your name and address, your telephone number, your email address, your profession or function, or any other element that makes you interesting to Val’U Srl. We may also process certain data that allows us to invite you to specific events.

  • For what purposes do we process this data?

We process this data in order to contact you or you in the context of defined circumstances or when specific opportunities arise. We group these purposes under the term “public relations”.

  • What is the basis for the treatment?

The processing of this data is based on our legitimate interest in undertaking and operating our business. This legitimate interest also covers public relations and the possibility of contacting others in defined circumstances or in connection with opportunities in connection with our business activities.

  • Do we share your data?

Your data is exclusively processed internally, by the services that need it.

  • How long do we keep your data?

We keep your data as long as your function, mandate or activity allows you to play a role for the benefit of Val’U Srl. Your data will be deleted as soon as this is no longer the case.

Chapter 11. Children’s data

Val’U Srl does not address children under thirteen years of age. Although visitors of all ages may browse our websites, we do not knowingly collect or request any personal data from children under the age of thirteen without parental consent. If it appears, as a result of the intervention of a parent or guardian, or in any other way, that a child under the age of thirteen has unlawfully registered on our site using false information, we delete the child’s account and delete the personal data concerning him from our registration files.

Section 2. How do we process and use your personal data?

Val’U Srl uses  the personal data it collects for various purposes. These purposes depend in particular on your role or your quality. In this regard, we invite you to consult the dedicated sections.

In this section, we inform you in general terms about the purposes for which we process personal data.

Val’U Srl uses the data it collects in order to provide you with the products or services it offers and to communicate with you, for example to give you information about your account, new Val’U products or services, security and other types of updates.

Val’U uses this data for the purposes opposite, (which we detail in this section): The offer of our products (including customer management); the use and improvement of digital products; training management; accounting; dispute management; supplier management; direct marketing (including advertising); communication; public relations.

Chapter 1. The offer of our products (customer management)

We use personal data to deliver, enable the use and maintain our Val’U products and services. This processing is necessary for the performance of the contract between us.

Chapter 2. Use and improvement of digital products

We first process your data to enable you to use our digital products. This includes informing you of software and security updates, as well as tracking maintenance issues. This processing is necessary for the performance of the contract between us.

We also use additional data for research purposes, as well as for the development and improvement of our Val’U products and services, including the maintenance and performance improvement of our Val’U products and services, as well as the design and addition of new products, features and possibilities, for example by consulting error reports (to improve security features),  search queries and clicks (to improve the relevance of search results) and usage data (to determine which new features should be prioritized). The purpose of this processing is our legitimate interest.

Chapter 3. Training management

We use personal data to organise training courses, and therefore to enable you to register, as well as to keep you informed of upcoming training courses that may be of interest to you. In this context, we also process the personal data of the persons who provide the training. This processing is necessary for the performance of the contract between us.

Chapter 4. Accounting

The purchase and sale of products and services requires various accounting treatments. It is therefore perfectly justified that we process your personal data, as a customer or supplier, learner or trainer, in order to make payment for products or services. This processing is necessary for the performance of the contract between us.

Chapter 5. Dispute management

If a dispute arises with you, as a customer or supplier, in connection with the delivery of a product or the provision of a service, your personal data will be processed in connection with this dispute. Your data may also be shared with lawyers or other professionals in the context of defending our interests.

Chapter 6. Supplier management

Chapter 8. Communication

We use personal data to answer questions from customers or third parties who visit us at events or browse our websites. When the communication concerns customers, it is also part of the purpose of “customer management” or “digital product management“.

Chapter 9. Public relations

We process personal data of natural persons and organisations capable of creating added value (goodwill) for the benefit of our company. The purpose of this processing is our legitimate interest.

Section 3. How do we share your personal data?

Val’U Srl does not sell or rent any personal data to third parties. We only share your data with third parties as described in this Privacy Policy.

Specifically, we may share your data in the following situations and/or with the following third parties: external service providers – subcontractors; professional organizations; partner companies; mandatory disclosure of data; or the sale or merger.

Chapter 1. External service providers — Subcontractors

Val’U Srl uses various external service providers for the performance of specific services, such as the management and hosting of its websites, online purchases and shipping of its products, the processing of credit card transactions and email communications. We only share your personal data as necessary, for example to complete a transaction or to provide products or services that you have ordered or authorized, and only with contractors or agents who work on our behalf and for the purposes described in this privacy statement. Where applicable, your personal data is shared with these service providers or agents, but only for the performance of the services provided in the name and on behalf of Val’U Srl, and in accordance with this privacy policy. For this purpose, we conclude the necessary contracts with the relevant third parties, in particular subcontracting agreements.

The products and services offered for sale through the Kipeps platform or online store – which is a digital product of Val’U Srl – may contain links to products or applications of third parties whose data protection policy may deviate from that of Val’U. The personal data you provide to these third parties or provide to their products is governed by their own data protection policy or privacy statement. Chapter 2.  Partner companies

We may share data with Val’U’s partner companies. These include companies that have signed a contract with Val’U as part of the products and services offered via its Kipeps platform and online store. This sharing only pursues a professional purpose, such as internal administration, the promotion of products or services via the Kipeps platform or online store, and the delivery or provision of these products and services. The sharing of data with these parties, for this specific purpose, is within the scope of our legitimate interest. You can always object to this (right to object).

Chapter 3. The case of mandatory data disclosure

We are required by law to disclose data about you in certain circumstances. When it is either required by law or strictly necessary for the performance  of our services or to protect our rights or those of our users, we may disclose your personal data to law enforcement authorities or in the context of legal proceedings, for example.

Chapter 4. The case of sale or merger

We may share your personal data in the event of a merger, acquisition or sale of all or a portion of our assets. We will of course notify you of this by e-mail and/or prominent notification on our website and inform you in this context of your rights.

The processing of your personal data may be based on various grounds. These depend on the circumstances, and mainly on your quality. These grounds – which we detail below – include: the performance of a contract; our legitimate interest; a legal obligation; your consent where required.

Chapter 1. Performance of a contract

The processing of your personal data may be necessary for the performance of the contract between us. For example, to complete payment for one of our services, create and manage your account, register your Val’U digital product, including your Kipeps online store, and ensure that it performs its basic functions securely, or pay your royalties, etc.

Chapter 2. Legitimate interest

In other cases, we process your personal data to serve one of our legitimate interests, such as our interest in undertaking and carrying out our business, the interest in communicating or securing our infrastructure, all of which are necessary to carry out our activities. You can exercise your right to object if we process your personal data on the basis of one of our legitimate interests and no opt-out mechanism is offered to you (e.g. in the settings of your digital product). Chapter 3. A legal obligation

We are sometimes required by law to process personal data. This is particularly the case for data relating to authors, which we are obliged to communicate to the FPS Finance as part of the withholding tax deduction.

Chapter 4. The consent of the data subject (the data subject)

Sometimes we need to obtain your consent. This is particularly required when we want to use electronic data, such as your e-mail address, to send you advertising messages. This consent is only required for prospects, not customers. We invite you to consult the explanations concerning the various roles and qualities in order to know which basis applies to which treatment.

Section 5. Security and storage of your personal data

Chapter 1. Security

Val’U takes the protection of your personal data seriously and does everything in its power to secure it. However, no security system is foolproof, despite all reasonable precautionary measures taken.

We put in place numerous appropriate technical and organisational measures and meet industry standards to protect your personal data against theft, misuse, and unauthorized access, disclosure, alteration or destruction of your data. For example, for this purpose, we store your personal data on IT systems hosted in a secure environment to which access is restricted. We also ensure that our external data center providers take appropriate security measures. Your data is also protected. Your passwords are stored in a , which means that they cannot be recovered or disclosed, not even by Val’U.

Access to your Val’U account information, for example regarding the online shop, and to our services is only possible by means of a unique identifier and a personal password. In order to ensure the confidentiality of your personal data, however, you must ensure that you keep your password secret and do not disclose it to anyone. Chapter 2. Storage

The personal data collected by Val’U may be stored and processed in Belgium (our head office), or in any other country in which Val’U or subcontractors are established or have infrastructures.

Section 6. How long do we keep your personal data?

Val’U keeps your personal data for as long as necessary to achieve the purposes pursued by their processing.

This means that we keep your data for as long as we remain in contact, i.e. as long as you remain one of our customers or suppliers. We then store your data for a maximum of ten (10) years after the end of our relationship, i.e. the period during which you can bring an action against us on the basis of the performance of the contract between us, considering that we may only be able to contest your requests by producing the data in our possession.

This also means that we keep your data for as long as necessary to allow you to use our websites and in particular our digital product (the Kipeps platform and online store), to allow us to deliver products and/or provide services, to comply with the legislation in force (in particular that relating to the retention of documents),  to resolve any disputes and, generally, to enable us to conduct our business.

The retention period depends on your quality and the purpose we pursue.

We keep customer data for as  long as they remain customers, and then for a maximum of ten (10) years after the end of the customer relationship in order to be able to contest any legal claims. We keep the data  of users of Val’U services or products –  including the digital platform and the “Kipeps” online store – as long as they remain users, then for a maximum of ten (10) years after the end of use, this is the reasonable time to guarantee a legal defense if necessary. We keep the data  of learners for a  maximum of ten (10) years after the end of the training, some of them sometimes asking us for certificates of attendance a posteriori.

We only store visitor data –  physical (e.g. at an event) and online – to a limited extent, unless visitors have another quality and their visit falls within that other quality. We only keep prospects‘ data for a limited period of time, considering that they are or can quickly become obsolete. However, we may subsequently obtain data relating to prospects from third parties and process them.

We keep suppliers’ data for as  long as they remain suppliers and then for a maximum of ten (10) years after the end of our relationship in order to be able to contest any legal claims.

We keep the authors’ data  for as  long as they collaborate with us as authors, and for a maximum of ten (10) years after the end of our collaboration in order to be able to contest any legal claims.

We store the data of contact persons or representatives of organizations or legal entities  for as long as these organizations or legal entities maintain a relationship with us, as a customer, supplier or otherwise, and for a maximum of ten (10) years after the end of our relationship in order to be able to contest any legal claims.

The retention of data after the end of the relationship does not mean that it will be used for all possible purposes. In principle, the data is stored passively after the end of the relationship. In other words, they are only kept for use in possible legal proceedings.

Section 7. Your rights

Val’U intends to give you control over how we use your personal data. To this end, you can exercise the rights that the applicable legislation assigns to you. Different possibilities are available to you, including:

  • You may refuse/withdraw your consent when it should be required (right to refuse / right to withdraw consent);
  • You can ask us to see the personal data we process about you (right of access);
  • You can ask us to rectify the personal data concerning you that we process (right to rectification);
  • You can ask us, in certain cases, to erase the personal data we process about you (right to erasure);
  • You can ask us, in certain cases, to block or restrict the processing of personal data concerning you that we process (right to data restriction);
  • Where the processing is based on one of our legitimate interests, you may exercise your right to object to such processing (right to object). We then weigh up your interests with ours to determine which ones should prevail and whether additional measures can or should be taken to restore balance.

In addition to the rights that the law explicitly grants you, you can always send us other requests, but you also have certain obligations:

  • You can inform us of a change to your personal data and ask us to save the change.

If you want, for example:

  • Limit or delete your profile data;

  • Or request the deletion of your profile data;

In these different situations, simply log in to your relevant Val’U account or send us an email at info@valugroupe.com. If you are unable to access specific personal data collected by Val’U through your Val’U account or directly through your digital product (e.g. “Kipeps online store”), you can send us an email at info@valugroupe.com.

We always respond as soon as possible, and within thirty (30) days maximum, to requests for access to personal data and requests for erasure of personal data.

Chapter 2. Your communication, marketing and advertising preferences

You may opt out of receiving direct marketing messages from Val’U by following the instructions provided in each email we send you, under the “Unsubscribe” button.

You can also unsubscribe from mailing lists by emailing us at info@valugroupe.com. We respect your decision and will therefore no longer send you promotional emails upon receipt of your unsubscription or as soon as your communication settings are changed.

Regardless of your communication settings, please note that we will continue to send you business information, such as changes to our terms, as well as updates to our policy and software for our Val’U products (e.g. the Kipeps platform). You will also continue to receive general customer service messages, including information about your current or past purchases, product payments, service interruptions, data breaches in accordance with applicable law, or other important information about a product or service you have purchased,  For example, the end of support for a specific product or service or security issues.

If you opt out of receiving emails from us, we will no longer use your email address for our interest-based promotional activities.

In the event of a material or substantial change in the general policy or in the way Val’U uses your personal data, we will notify you either by posting a notice of the changes before they come into force, or by sending you a notice of this type directly.
